The rifle recovered at Sumter’s residence had not been registered. It is a violation of federal law to possess an unregistered short-barreled rifle.

So it's registration.... disguised as a tax stamp, hence was free. Sneaky AFT....

Sooo a pistol brace is a short barreled rifle now?

Forgive me, I don't keep up with bullshit.

Given there are no pictures who's to say that somebody didn't change the rear portion with the buffer tube into an actual stock.

Ontop of that yes all of you who filed Form 1's for this, it's that transparent.

Not your average law abiding gun owner and the case is from 2021.

According to the U.S. Department of Justice, over 14 pounds of marijuana and three firearms, including 5.56mm American Tactical, model Omni-Hybrid, Multi-Caliber, short-barreled rifle were found during a search by deputies at Rondrell Sumter’s, 39, residence on August 2, 2021.

Federal law also prohibits Sumter from possessing firearms due to his prior convictions, including four prior convictions for possession with intent to distribute or distribution of narcotics.

This has always been the case. There are very very few prosecutions of 'just' an SBR, SBS, even FA. Aside from the idiots who post them for sale online and get tagged by the Jr BAFTEEE crew.

They are 'tack-on' charges 99% of the time. Usually the main charges are for other brain dead stupidity like drugs, theft, and other stuff like felon with a guns, etc.

My f-meter is pegged at zero for idiots. I'd also say this rocket scientist was also already a felon, but I know you like them having firearms, lolz.

    Don't forget this part.

A Columbia man was sentenced to 180 months in federal prison after pleading guilty for being a Felon in Possession of a Firearm and Ammunition and Possession of an Unregistered Short-Barreled Rifle.

    Might be something....

The fact is that, per 18 U.S. Code § 921, the term “short-barreled rifle” means a rifle having one or more barrels less than sixteen inches in length and any weapon made from a rifle (whether by alteration, modification, or otherwise) if such weapon, as modified, has an overall length of less than twenty-six inches.

Per 18 U.S.C., § 921(A)(29) and 27 CFR § 478.11, a "pistol" means a weapon originally designed, made, and intended to fire a projectile (bullet) from one or more barrels when held in one hand, and having:
    1. a chamber(s) as an integral part(s) of, or permanently aligned with, the bore(s);
    2. and a short stock designed to be gripped by one hand at an angle to and extending below the line of the bore(s).
It cannot have a buttstock or a vertical grip.

According to the ATF, a pistol brace, also known as a stabilizing brace or arm brace, is an accessory attached to the rear of a gun that allows the weapon to be fired one-handed. The brace uses Velcro to attach the firearm to a person's arm, stabilizing the gun.

The ATF's new rule should be struck down as it violates federal laws and the 2nd Amendment. The ATF does not have the authority to change definitions that are defined by law. A pistol with a brace is NOT a SBR as it does not have a buttstock.

You know the way it’s written it is hard to interpret, I would like to think as a basis in law the “tie goes to the runner” meaning if there is any doubt lean towards freedom vs prosecution. Something tells me it’s the opposite of that and we are more of a guilty until proven innocent society nowadays

And thats the crux of a Law vs. a Regulation..
In a Law you are presumed innocent until convicted by a Jury of you Peers. With a regulatory body; they find you "Non Compliant" and fine you. AKA: You are running a restaurant and the health inspector finds you not washing your hands.. You are non compliant in the handwashing rule and they fine you 10000 per day until you fix your situation.
The shitty thing with ATF is they are a regulatory body that was given arrest powers. So you can be found "Non Compliant" on a rule that gets changed willy nilly. How this was not deemed Unconstitutional on its face is crazy to me.

You have to have the right last name for that to work, or at least be a registered democrat. Me personally I would rather go to jail than be either one of those.

That’s exactly what they want, too.

Answer is “None of the above.”

The traitors need to answer for their crimes. The “swamp” is just the sewer backed up so bad it’s spilled out of the house and into the yard so long that the entire neighborhood is affected. These actions from the BATFE(CES) are just more indicators of how this regime views “We the People”.

It sure would be nice if enough “decision-makers” would uphold their oath and stop betraying their sacred trust.
    Wouldn‘t that be something…
