    From what I have read this was murder, not self defense. The guy was texting his 3 year old (baby sitter was reading it to his kid )during the previews. Good grief there is truly some a*#holes in this world.

    No offense to anybody here but old men can be dangerous as hell. First off, they are paranoid about letting a younger guy get hold of them because they wouldn't be able to fight them off , second they are generally fed up and third they don't have a whole lot to lose.
    It's just not smart to fly off the handle these days. You just never know when somebody is going to snap.

    I'll be specific.

    Fact: The expired man assaulted the grumpy old guy by attacking him in the face.

    Fact: they exchanged words or "Language" this exchange might of included things like: I'm going to kick the living shit out of you! Or it could of been please pass the popcorn.

    Body language: aggressive balling of fist. Standing up with fist clinched and closing the gap between the man he just assaulted in the face.

    His day in court is coming. With his history and the right recollection of what he perceived to of happened he will walk.

    No offence taken by this old man. But I am from the north and you know you can't trust any of them,and you are right we might snap any time if we havent had our laxitave(spell) and no sex for a few years. Nothing to lose any more.     FN, if that is how you feel and act I think you will be in jail real soon, none of that would be cause to kill a man..You really need to do some soul searching and reading of the laws. Nothing personal just free advice and you get what you pay for.

    I saw a photo of the decedant with a buddy -- in biker garb (you know black shirt, tats, chain wallet, etc.) -- maybe he was in that "bad boy" mode when he had "language" with the old geezer.... And the elderly of the two felt threatened. I'm not so sure this will be a slam dunk case until all the witnesses are interviewed by investogators, deposed by attorneys, and testify with cross examination in court.

    One question I have is if the off duty cop was close enough to be an eye witness -- why didn't he identify himself and intervene before the confrontation escalated to the point of gun fire??

    The talking heads on several networks were using this incident to attack concealed carry firearms tonight -- at least on the liberal news networks...

    Because as we all know, shit can get hairy pretty quickly, and perhaps he didnt think it would escalate so fast or end up with this conclusion.

    So now you're saying somebody can just say they fear for their life when they get into an argument that they themselves started and claim self defense??? If this cop gets off our stand your ground law is all but done.

    Assault with popcorn Hmmm does not sound life threatening. The crux of the case may be whether you "feeling your life is threatened" is the same as it actually being threatened. Just because you feel something does not make it true.

    Good one, but when I watch the news channel 5 seems like Mobile area is murder capital of the south? although it always seems to be ganster related black on black? I just wish we could all get along.

    Because we have the most concealed carry licenses out of any State and the permit is too easy to get.

    It occurs to me that we are sort of like the blind men feeling the elephant. I like the rationality of almost all of the posts, but no one has cited the Florida statute, and that might demonstrate that legal language might still be like looking at an inkblot. I commend to you, FL statute 776.013 subsection 3. Both parties had a legal right to be where they were, and thus, both had the right to stand their ground, if assaulted or attacked. Both had the right to meet force with force, INCLUDING deadly force, IF REASONABLY believing it was necessary to do so to prevent death or great bodily harm.
    IMO, therein lies the difficulty for grand jurors. WHAT is the definition of reasonable in this case!!?? We do not know about the kind of posturing, or amount and kind of assaultive language. We do not know anything about the emotional health, or lack of it, of the combatants, so we view the "reasonableness" or "unreasonableness" through our own individual judgmental prisms. To me, those would have to be factors which would have to be instructed by the Judge of the grand jury hearing.
    Please pardon the "lecture". My own perceptual prism says a potentially lethal 380 round is NOT reasonable force against thrown popcorn, unless the retired policeman was emotionally unbalanced, and was known to have demonstrated recent examples of irresponsible and inappropriate violence. Then, a good lawyer might recommend an insanity plea, if the grand jury indicted.
