My M11/9 sold in 15 minutes on gunbroker today and the buyer lives in Pennsylvania. I know I have to ship to a class3 dealer and I will have to have a copy of his FFL first before I ship.
my question is , what paperwork do I need to do? I guess I could ask him but the more advice I get the better.
do I have to get anything from ATF first? or will all of that be handled by the buyers class3 dealer that I ship this to

OK i think I got it. I think I have to wait on ATF to return the paperwork [ form 4? ] before I can ship to the class 3 dealer and then the buyer has to wait for the class 3 dealer to get his paperwork back before he can pick up the MG
wow this poor guy may have to wait a year! am I right?

Wrong, use ATF Form 3 for transfers to dealers. Form 4's have some sort of tax paid.

    http://www.atf.gov/forms/download/atf-f-5320-3.pdf

Once the dealer in PA has it then he can start the form 4 on the individual.

    Sure?

I was under the impression that a Form 3 was for Dealer to Dealer.

    Individual/trust to a Dealer is still a Form 4.

It would seem the OP was correct, unless he's a Dealer.

If you've got better info I would appreciate it. Still trying to figure this stuff out.

I asked a friend who is a Class 3 dealer and this is what he said i do before I ship it to the class 3 dealer

" You will need to get the approved form 4 back from NFA first. (Only the front needs to be filled out to the dealer) "

The dual stamp is a pain.

I'm in the process of doing a form 4 to form 4. Transferor is in southern FL, saved a stamp.

Nevermind you do use the form 4. I just checked this ATF faq.

    http://www.atf.gov/publications/download/p/atf-p-5320-8/atf-p-5320-8-chapter-9.pdf

The form 3 is for FFL to FFL. The way the forms are written can be somewhat confusing and ambiguous. By the way according to the above faq, you do have to pay a transfer tax since you don't have an FFL/SOT. The good news it that the transfer time won't take long since its going to an FFL.
