I do not think the prosecutor really expects to win in a fair court. But if Biden wins 100 days from now, a legal lynching may be possible and the law be D_mned in her opinion.

Mccloskey's need to request a speedy Trial (I hope they haven't Waived that for maneuvering room), they may want a change in Venue (location/jury pool). Who knows what political positions (elected/appointed) may shift to the dark side. Rights and Lawyer Licensing/Bar would be better served with an acquittal. Commutation, Pardon and Clemency achieve different things.
