    Florida has castle doctrine you come home find an armed trespasser in your home shoot him dead as your life and property were in danger.
    You are within your rights.
    The only witnesses to tell the story better be you and your family and then only after you've got a hell of an attorney. The feds have stacked the deck against us.

    Usually they take over homes that are rental properties or otherwise abandoned homes. There are some laws on the books in some places that require property owners to have to go through the full eviction process to get people out, and sometimes it can be hard even then.

    The other version (that I have seen first-hand) is where scammers take photos of a property and post it “for rent.“ They take an online deposit/payment and the renters show up and help themselves to the house, because they believe they have rented it legitimately.

    This is becoming more and more common. I’ve known people on both sides of this.

    Often the tenants have had utilities connected in their name and started to receive mail, at this point they can’t be just kicked out, but have to be legally evicted just like a squatter.

    The difference here may be more discretion from the owner as the the inhabitants are also victims and did not set out to break any laws. The situation I am aware of that started like this ended in a win/win, with the scammed tenant signing a legit lease with the property owner, who waived first/last as the tenants had just lost their savings to the fake landlord. As far as I know they ended up being good tenants.

    Won't fly where I work.

    We will arrest for Trespassing or Burglary depending on certain facts.

    Glad to hear there are some agencies doing the right thing! I’m sure for every horror story we hear there are tons of easily resolved cases.

    I was told when i bought my home that it was unoccupied during katrina. The owners son in law came by to check on the house one day and some people from new orleans had kicked the front door in and were living here. He didnt get around to telling how he got rid of them.
    vertical or horizontal, your choice, one way or another, you are leaving right now, no 30day notice, 3 days or 3 hours, yo butt has 3 minutes...

    That's the best thing I've heard so far. I hope all Florida Sheriff's take the same position.

    I failed to acknowledge a possible exception such as someone scammed in a rental situation. I suspect if they have been there long enough to receive mail and establish utilities our legal guidance would most likely be to direct the property owner or authorized representative to the Clerk of Court for the eviction process.

    With that said, the subjects will need to provide some very detailed and specific information to support their position... a couple text messages won't cut it.

    The nice thing about living not in a city is few neighbors and everyone is used to "gun fire" either plinking in the back yard, "tree rat" control, testing loads for pressure , ect. and lots of places to dispose of garbage

    Florida law was adjusted a few years back to combat this trend. It used to be super difficult to get someone out who had established legal residency, which was not hard to do.

    I have a horror story about a fairly successful dude in his mid 30's that picked up a chick in a bar, took her home, banged her a few times, and let her crash in his nice house in a nice part of town for a few days. He finally tells her to GTFO (probably to make room for the next one) and she doesn't want to go. Voices get raised and he tells her to be gone before he gets back from work. In the meantime, she calls the po-po, makes a domestic violence allegation using his house as her address, gets an emergency restraining order and he comes home to find the Sheriff's Office there. They serve him, and he had to leave his own house and stay in a hotel while a chick he has known for less than a week has full run of his house and he can't even walk on his own property whether she was there or not.
